1. Introduction

This Terms of Service ("Terms") is a legally binding agreement between you ("User," "You," or "Your") and AlphaMaga ("We," "Us," or "Our"). By accessing, registering, or using any part of the AlphaMaga platform, software, or services (collectively referred to as the "Service"), you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.

These Terms govern your use of the Service, including but not limited to the creation and management of your Account, the application for and repayment of loans, and the processing of your Personal Information. Any amendments or variations to these Terms shall be effective upon publication on the AlphaMaga platform.

2. Definitions

In these Terms of Use, the following terms shall have the following meanings:

Account: Your personal account to access the Service.

Applicable Law: All relevant laws, regulations, and rules in effect.

Business Day: A day other than Saturday, Sunday, or a national/public holiday in Ghana.

Corporation: Any entity that controls, is controlled by, or is under common control with a party.

Credit Reference Bureau: The Credit Reference Bureau of Ghana, which collects and distributes customer credit information.

Group Companies: A person and its affiliates.

Identifier: Your personal identification used to access the Service and operate your Account.

Interest: The cost of borrowing money, calculated as a percentage of the loan principal, payable by you to AlphaMaga over the loan term. Interest rates will be displayed on the App and may vary based on your credit profile and loan terms.

Loan: The principal amount borrowed or to be borrowed through the Service.

Local Terms and Conditions: Additional terms that may apply to specific regions or services.

Mobile Device: Any device (e.g., phone, tablet, laptop) used to access the Service.

Mobile Money Account: Your mobile money store of value, maintained by a Mobile Money Provider in Ghana.

Personal Information: Data that identifies you, such as name, address, financial details, and more.

Request: A request or instruction submitted by you through the Service.

Service: Any financial service or product provided by AlphaMaga.

Service Fees: Charges for using the Service, as published on the App.

SIM Card: A customer identification module used to access mobile money services.

SMS: Short message service for text communication.

Special Terms and Conditions: Additional terms that may apply to specific parts of the Service.

System: The AlphaMaga platform, including software, websites, and related systems.

Website: Any website operated by AlphaMaga or its Group Companies.

3. Your Warranties and Responsibilities

By using the Service, you represent, warrant, and agree to the following:

Authority: You have the legal capacity and authority to enter into these Terms and to perform your obligations hereunder.

Compliance: You will comply with all Applicable Laws and these Terms at all times. You will promptly notify AlphaMaga if you become aware of any breach of these Terms or Applicable Laws.

Lawful Use: You will use the Service only for lawful purposes and in accordance with its intended use.

Accuracy of Information: All information, documents, and Personal Information provided by you to AlphaMaga (whether directly or through the System) will be accurate, complete, and not misleading.

Account Security: You will not share your Account credentials with any third party and will take all necessary steps to protect the security of your Account.

Prohibited Conduct: You will not engage in any fraudulent, illegal, or harmful activities, including but not limited to circumventing the proper functioning of the Service or interfering with other users' access to the Service.

4. Acceptance of Terms

Review of Terms: Before using the Service, you must carefully read and understand these Terms. By downloading the AlphaMaga App, registering an Account, or using the Service, you confirm your acceptance of these Terms.

Amendments: AlphaMaga reserves the right to amend these Terms at any time. Your continued use of the Service constitutes your acceptance of any such amendments. AlphaMaga will use reasonable efforts to notify you of material changes to the Terms.

Technical Updates: Periodic updates to the AlphaMaga App may require you to download the latest version and agree to any new terms.

5. Account Registration and Use

Registration: To use the Service, you must create an Account by providing accurate and complete information.

Account Security: You are responsible for all activities under your Account. Do not share your credentials with any third party.

Account Suspension: We may suspend or terminate your Account if you violate these Terms or for security reasons.

6. Loans and Financial Terms

Loan Eligibility: Loans are available only to users over 18 years old who meet the eligibility criteria set by AlphaMaga.

Interest and Fees: Loan terms, interest rates, and Service Fees will be displayed on the App. Interest rates may vary based on your credit profile and loan terms.

Repayment: You must repay loans on the due date. Failure to repay may result in penalties, additional interest, and reporting to the Credit Reference Bureau.

7. Prohibited Activities

You may not:

1.Use the Service for any illegal or unauthorized purpose.

2.Attempt to reverse engineer, decompile, or exploit the AlphaMaga System.

3.Share your Account credentials or allow any third party to access your Account.

4.Engage in any activity that disrupts or interferes with the proper functioning of the Service.

8. Privacy and Data Use

Your use of the Service is subject to AlphaMaga's Privacy Policy, which outlines how we collect, use, and protect your Personal Information. By using the Service, you consent to:

1.The collection and use of your credit information for credit assessment purposes.

2.Receiving direct marketing communications from AlphaMaga (you may opt out at any time).

9. Liability and Disclaimers

Service Availability: We are not liable for Service interruptions due to technical issues or events beyond our control.

User Responsibility: You are responsible for any losses caused by your misuse of the Service.

Limitation of Liability: Our liability is limited to the Service Fees paid by you in the last 12 months.

10. Dispute Resolution

Governing Law: These Terms is governed by the laws of Ghana.

Arbitration: Any disputes will be resolved through arbitration in Accra, Ghana.

Injunctive Relief: Either party may seek injunctive relief from a court of competent jurisdiction.

11. Amendments and Termination

Changes to Terms: We may update these Terms at any time. Continued use of the Service constitutes acceptance of the updated Terms.

Termination: We may terminate your access to the Service for any reason, with or without notice.

12. General Provisions

Assignment: We may transfer our rights under these Terms without your consent.

Severability: If any part of these Terms is found invalid, the remaining terms will remain in effect.

13. Anti-Money Laundering (AML)

You agree to provide accurate and complete information to comply with Ghana's anti-money laundering regulations. AlphaMaga reserves the right to reject any transaction that appears suspicious or violates Applicable Laws.

14. Credit Reporting

By using the Service, you authorize AlphaMaga to report your loan application, repayment history, and other credit-related information to the Credit Reference Bureau of Ghana.

15. Minors

The Service is not available to individuals under the age of 18. If we discover that a minor has used the Service, we will terminate their Account immediately.
